Terms & Conditions

Please read carefully these terms and conditions of contract. In completing and submitting the Booking Form, you agree to be bound by these conditions which constitute the agreement between Calder & Lawson Tours (also referred to as C&L Tours) and yourself. By completing and submitting the Booking Form you affirm that you:

  • are over the age of 18 and legally competent to give the waiver, release and indemnity contained in it;
  • understand that this document is contractual in nature, has legal effect and is not merely a warning nor provided for information purposes;
  • understand that C&L Tours have relied upon your execution of the document in allowing your participation in the tour.
DOMESTIC TOUR FEE INCLUSIONS
  • Coach or train travel as specified in the itinerary
  • Accommodation on a share-twin basis in hotels and/or ship cabins
  • Meals as specified in the itinerary
  • Activities and admissions as specified in the itinerary
  • All group transfers
  • Other inclusions as specified in the itinerary and will vary according to the tour type
 
DOMESTIC TOUR FEE EXCLUSIONS
  • Any flights to/from the tour start and end point (these can be arranged for you upon request)
  • Personal expenses
  • Beverages during meals, unless specified
  • Other meals not specified in the itinerary
  • Costs for variations made outside the group arrangements
  • Travel insurance
    Costs of any optional trips offered
  • If you wish to pay by visa/ master card, a surcharge of 1.5%, Amex 3%, will be charged
 
INTERNATIONAL TOUR FEE INCLUSIONS
  • Economy class air travel, if specified (excluding airport taxes)
  • Group airport transfers and any coach or train travel as specified in the itinerary
  • Accommodation on a share-twin basis in hotels and/or ship cabins
  • Meals as specified in the itinerary
  • Entrance fees as specified in the itinerary
  • Gratuities where required for local guides and/or crew of any included ships as specified in the tour itinerary
 
INTERNATIONAL TOUR FEE EXCLUSIONS
  • Passport costs (passports must be current and valid for at least six months after return to New Zealand)
  • Any visa requirements unless specified in the itinerary
  • Airfares and airline/departure taxes
  • Costs for variations made outside the group arrangements
  • Travel insurance
  • Costs of any optional trips offered
 
DISCOUNTS AVAILABLE (International tours only)
  • Previous Tour Discount – $200 per person
 
VARIATIONS IN TRAVEL

Calder & Lawson Tours are happy to arrange for you to combine your tour with other travel you wish to undertake, and to quote on these additions. Variations are

subject to airline regulations. Any variation in travel plans must be made and confirmed at least three months prior to travel. In most cases you may upgrade to Premier Economy or Business Class when these services are available.

 
PAYMENT METHOD

Your tour deposit and fee can be paid by cash, direct debit or credit card. Credit card surcharge is Visa/ Mastercard 1.5%, Amex 3%.

 
INTERNATIONAL TOURS REGISTRATION

A deposit of $1,000 per person is required with your registration. Some tours featuring cruises or trains may require increased deposits. To secure a place on any of our international tours please complete your registration (online or paper form) and return with your deposit to Calder & Lawson Tours. A place is not guaranteed unless your deposit has been received. Registrations will be accepted in order of receipt of deposits.

 
NZ DOMESTIC TOURS REGISTRATION

A deposit of $1,000 per person is required with your registration. Some tours featuring cruises or trains may require increased deposits. To secure a place on a NZ domestic tour, please complete your registration (online or paper form) and pay your deposit to Calder & Lawson Tours. A place is not guaranteed unless your deposit has been received. Registrations will be accepted in order of receipt of deposits. NZ domestic tours are not eligible for a Previous Tour Discount.

 
FULL PAYMENT

The balance of the tour fee is payable on or before a date which will be advised to you by Calder & Lawson Tours. This is approximately 3-4 months prior to departure.

 
INSURANCE

Personal travel insurance is mandatory, and a condition of travel, for anyone travelling on a Calder & Lawson Tour to have full and comprehensive travel insurance cover. For all tours including ocean cruising you must include cruise cover with ship evacuation cover. Recommended policy provisions can be e-mailed to all participants. For an additional charge the policy may include cover for pre-existing and declared medical conditions subject to approval from the insurance provider. In the event that travel insurance has been arranged privately, confirmation in writing must be received prior to the date by which the balance of the tour fee is payable.

 
HEALTH & FITNESS

You must be in good health and physical condition and are strongly advised to follow our pre departure fitness training recommendations. You will be required to submit a medical questionnaire prior to departure. If you have a pre existing medical condition consult travel insurance requirements and if needed, discuss this with your doctor to determine if you are fit to participate. Tours can take place in remote areas where there is reduced access to normal medical services or hospital facilities for serious problems. Evacuation, where necessary, can be prolonged, difficult and expensive. Medical and evacuation expenses will be your responsibility, but insurance may cover you depending on the circumstances. While we do not discriminate by age, please carefully consider your ability to participate on walking/biking tours. Calder & Lawson Tours reserves the right in its absolute discretion to refuse a participant the right to participate on a tour.

 
COMPLAINTS

If during the course of your tour you have a problem, please bring this to the immediate attention of the tour manager or relevant supplier (eg. transport provider, hotelier). If your complaint is not resolved to your satisfaction, please contact the C&L Tours office by email or phone and they will endeavour to assist you.

 
ASSUMPTION OF RISK

You acknowledge and agree that:

• by the very nature of active travel and biking/walking holidays, they are more challenging and demanding with a commensurately higher level of risk compared with conventional holidays, and involve potential exposure to injury and possibly death;

• in the countries and regions in which active travel is undertaken, standards of accommodation, transport, health care, hygiene, safety and service provision generally are often not as high as those standards in your country of residence and may require flexibility and patience on your part;

• the additional dangers and risks associated with active travel may include difficult and dangerous terrain, high altitude, extremes of weather, including sudden and unexpected changes, political instability, remoteness from normal medical services and from communications, and evacuation difficulties in the event of illness or injury;

• you have submitted your booking for the tour after giving due consideration of relevant travel information including, without limitation, any relevant information or advice given by the New Zealand government and that it is your responsibility to acquaint yourself with that information or advice.

For the above reasons you therefore accept the inherent and increased dangers and risks associated with the proposed tour and the accompanying risk of injury, death or property damage or loss.

 
EXCLUSION OF LIABILITY

You acknowledge and agree that: To the fullest extent permitted by law and unless caused by the negligent or reckless conduct of (as per the Consumer Guarantee Act 1993), you hereby exclude, release and forever discharge C&L Tours and their representatives from liability for all claims including, without limitation, claims for loss of profits, consequential, exemplary and aggravated damages, for:

(a) your death or physical or mental injury or the death or physical or psychological injury of any other person; and

(b) damage to or loss of your property or the property of any other person, arising from or connected with your participation in the recreational services which comprise the tour.

 
ITINERARIES & BROCHURES

Itineraries and other details are published in good faith as statements of intention only and reasonable changes in the itinerary and related items may be made where deemed necessary or advisable by C&L Tours. The information contained on C&L Tours website, brochures, trip notes and pre departure information is to the best of C&L Tours belief, correct at the date of publishing.

 
PRIVACY ACT WAIVER

You consent to Calder & Lawson Tours collecting personal information & information regarding your health and medical conditions from you. You acknowledge that this personal information may be disclosed to Calder & Lawson Tours representatives/suppliers in order to ensure your safety and well-being but will not be used by them for any other purpose.

 
TRAVELLERS WHO REQUIRE ASSISTANCE

You are required to disclose to us at time of booking, any disability requiring special attention. This includes physical disability, difficulty walking, hearing or eyesight impairment, or any neurological disorders. While every effort is made to accommodate such difficulties, we are not responsible in the event we are unable to do so, and are not responsible for any denial of services by carriers, hotels, or other independent suppliers. Our concern must always be for the enjoyment and welfare of the group as a whole, and we regret that we cannot provide individual assistance to participants for walking, getting on and off motor coaches or vessels, or other personal needs. A physically and mentally able companion must accompany travellers who need such assistance and do so at their own cost.

 
VACCINATIONS

We strongly recommend that you consult with your doctor or travel doctor, particularly for travel to developing countries.

 
ON-TOUR SICKNESS

If you develop a cold or other respiratory infection while on tour, we reserve the right to ask you to wear a mask and to distance yourself from others as much as is reasonably practicable. We will not ask you, or require anyone else, to leave the tour or miss scheduled activities unless we consider it unsafe for you to continue or you require professional medical attention. We recognise that managing illness within a group setting can be challenging, particularly for other travellers who may be concerned about infection. Your Calder & Lawson tour manager will make reasonable efforts to support both the unwell individual and the wider group, within the practical limits of group travel.

We ask for your understanding and cooperation in advance, as decisions will be made in the interests of individual health and the wellbeing of the group as a whole.

 
TOUR MANAGER

Calder & Lawson Tours group tours will be led by a person especially chosen for her/his organisational and people skills. Her/his role is to look after all travel arrangements and well-being of the group. Calder & Lawson Tours shall not be liable for any loss or expense arising from any statement, advice or recommendation made by the Tour Manager or any other servant of the Company, nor responsible for any decision made by any person as a result of any such statement, advice or recommendation. The Tour Manager will do her/his best to ensure that your tour is worry free, safe and satisfying. Calder & Lawson Tours reserves the right to make changes to the Tour Manager at any time.

 
SINGLE SUPPLEMENT AND ROOM SHARING

For clients travelling alone, a single supplement is payable. Calder & Lawson Tours are allocated a limited number of single occupancy accommodation and therefore stipulate that single supplements are subject to availability.

Travellers looking to book on a twin share basis must either nominate a companion or be willing to share with another traveller. While we will endeavour to match rooming partners, this cannot be guaranteed. If a suitable match cannot be found by the final payment deadline, the single supplement will apply. Should a single supplement / place not be available, we reserve the right to cancel the booking in accordance with our cancellation policy.

 
SOLO TRAVELLERS LOOKING TO SHARE

Should single passengers prefer to share with a stranger of the same gender, Calder & Lawson Tours may be able to assist. However such arrangements are solely between the passengers concerned, and Calder & Lawson Tours accepts no responsibility for compatibility, nor guarantees being able to supply a twin share partner. Such arrangements are entered into on the understanding that both passengers travel together for the entire journey. Should a twin share partner not be found, or should one party cancel from the tour, at any stage, the single supplement will be applied to the remaining passenger.

 
DEPARTURE GUARANTEE

The tour will proceed provided that the specified minimum number of

deposits have been received. Calder & Lawson Tours will contact those registered on the tour to advise when that tour is a definite departure.

 
CANCELLATION / WITHDRAWAL

If the tour is cancelled due to minimum numbers not being reached by Calder & Lawson Tours, the deposit paid will be refunded minus any credit card charges. Calder & Lawson Tours are unable to take responsibility should a tour not operate due to natural disaster, epidemic or pandemic, political unrest, travel bans or other such events beyond our control. It is the passenger’s responsibility to have travel insurance in place to cover such eventualities. It is therefore essential that travel insurance is arranged and paid for prior to the date by which the progress or final payments are due. Once the deposit has been made and the tour is confirmed, your deposit is non-refundable. All progress and final payments made are non-refundable. Again insurance cover is therefore essential.

 
ROUTE CHANGES, POSPONEMENT, CANCELLATION OR DELAY

Calder & Lawson Tours reserves the right to either before or during:

• cancel or modify any routes within the tour or objectives set out in the itinerary; or

• substitute different or equivalent routes within the tour in place of cancelled or modified routes, or

• postpone, cancel or delay (either in relation to the departure or arrival times or the duration of the tour) any such aspect of the tour if, in the absolute discretion of Calder & Lawson Tours, it is necessary to do so due to inclement weather, snow or icy conditions or circumstances that are known to us and are otherwise likely to be hazardous or dangerous or due to any other adverse or threatening conditions whether political or military or terrorist or otherwise or if, in the absolute discretion of Calder & Lawson Tours, there is a likelihood of any such event occurring which may impact upon the safety of the participants, or if an act or omission of a third party prevents the tour or any aspect of the tour being undertaken in accordance with your booking or for any other reason considered necessary by Calder & Lawson Tours.

In the event of any change, modification, cancellation, postponement or delay under this condition, you acknowledge that you will have no right of refund of the tour price (whether in whole or in part) and no right to claim compensation for any injury, loss or damage or other additional expenses incurred by virtue of the change, modification, cancellation, postponement or delay.

 
FORCE MAJEURE

If Calder & Lawson Tours is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of an act of God, strikes, trade disputes, fire, breakdowns, epidemics and pandemics, interruption of transport , government or political action, travel bans imposed by governments, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside Calder & Lawson Tours reasonable control, Calder & Lawson Tours will be under no liability whatsoever to you and may, at its option, by written notice to you cancel the tour wherein the cancellation / withdrawal clause of these conditions will apply in respect of cancellation charges.

 
IMAGES

By accepting these terms and conditions you certify that your image may be used without charge by Calder & Lawson Tours for promotional purposes including but not limited to the website, printed promotional items and promotional presentations, unless you notify us in writing that you do not wish to have your image to be used for these purposes.

 
WAIVER

A party will not be deemed to have waived any of its rights or remedies under these conditions or at law by allowing any time or indulgence or by not exercising any right or remedy arising out of any default by the other party.

 
JURISDICTION

This agreement and the rights and obligations of the parties will be construed and take effect in accordance with and be governed by the laws of New Zealand.
